General conditions of sale
1. Prevalence
Delivery, services and offers of mawo-cards are always subject to our general terms and conditions. Contradictory and other arrangements need our expressed affirmation. An affirmation via e-mail is enough.
2. Contract conlcusion
The offers on the website of mawo-cards are non-binding and subject to change. Slight discrepancies and technic changes compared to the pictures and descriptions are possible.
The contract is valid, as soon as the order transaction via the website of mawo-cards is completed by the customer and a mail of confirmation has been sent by mawo-cards. Prior to completing the order the customer has the possibility of checking, changing and deleting their order in the shopping cart. By sending the order the customer confirms to be 18 years or, if underaged, to have the consentment of a legal guardian.
3. Prices
The prices that are shown on the websites of mawo-cards at the time of purchase apply (subject to spelling mistakes and incorrect comma placement, changes in prices). All prices shown by mawo-cards – unless expressively declared otherwise - include value-added tax and exclude shipping and mailing expenses. If the customer does not raise a well-founded objection to our bill (written or via e-mail) within two weeks, the bill is seen as approved.
4. Conditions of payment
mawo-cards accepts all payment methods shown on the website (within the order transaction). The customer choses the preferred payment method.
5. Withdrawal from contract
In case of errors on the website (spelling, printing and calculation errors) mawo-cards has the right to withdraw from the contract.
Customers can withdraw from the contract within 14 workdays in written form (or per e-mail). The time limit starts with the day of delivery to the customer. It is sufficient to send the written withdrawal or the wares within the time limit without having to state reasons for the withdrawal. Saturdays are not counted among workdays.
In case of withdrawal by the customer the purchase price is only refunded totally or partially, if the wares have arrived at mawo-cards and have been checked. The costs for the reshipment must be paid by the customer. Wares are supposed to be returned unused and in original packaging to the adress shown at the website. In case of traces of use or damaged packaging, we keep an adequate fee for the decline in value. The same applies if parts or supplies are missing at the time of return. In case the wares are sent back not prepaid, we have the right to keep an appropriate amount.
6. Delivery, transport
The shipping and mailing expenses are shown to the customer on the website before completing the order.
Wares that are in stock are normally brought to dispatch within one week after receipt of payment.
For wares that are not in stock (e.g. for pre-orders) the delivery time can be delayed until the date, which is given on the website (subject to in-time delivery to mawo-cards). If delivery cannot be fulfiled due to reasons not in our responsibility, mawo-cards can withdraw from the contract. In this case mawo-cards will inform the customer in time. Payments the customer already provided will be repaid immediately. The customer does not have entitlement to damages.
It is also possible to arrange part-deliveries. Costs for transport and package will be billed only once.
Costs and risks of the transport must be beared by the customer (unless another arrangement has been made with mawo-cards). Apparant defects (especially damages, wrong deliveries, discrepancies in quantum) and other defects must reported immediately (within 14 calendar days after delivery) to mawo-cards (in written form or by e-mail). Damages due to transport (e.g. damaged packaging at the time of delivery) must be claimed by the customer directly at the transport enterprise.
7. Guarantee
mawo-cards does not assume liability for the constant and non-stop availability of the website and for technic and electronic errors in the online offers.
8. Place of fulfilment
Place of fulfillment is the registered office of our business in Mödling.
9. Place of jurisdiction
Austrian law applies. Application of UN-Law on the International Sale of Goods is expressively excluded. Language of contract is German. The contracting parties agree on Austrian internal jurisdiction.
